Has Your Life Insurance Policy Been Rescinded?

Rescission of a life insurance policy is used to describe the reversal, or undoing, of a life insurance contract. Essentially, the insurance company is erasing the existing life insurance policy and denying the beneficiaries their death benefits. The life insurance policy may be rescinded for many reasons, including divorce, misrepresentation, alleged fraud, no insurable interest, suicide, a beneficiary change or a missed premium payment.           Unfortunately, in Missouri, and across the country, life insurance companies are rescinding more and more policies as many people don’t even fight a denial of their life insurance benefits. The Missouri Department of Insurance, received more than 420 complaints regarding life insurance and annuity companies in Missouri for the year 2012. You can see the full report here. Stat. $ 375.1007(12) (2006).

Delaying the Payment of a Life Insurance Policy

Often times we get calls from beneficiaries of life insurance policies stating that the insurance company has delayed the payout of their benefits. In Missouri, after the appropriate forms have been completed and submitted a life insurance company must advise you of acceptance or denial of a claim within 15 working days after submission of such forms. Mo. Code Regs. Ann. tit. 20, § 100-1.050 (2006). Despite the Missouri code regarding the payout of life insurance policies we have seen investigations last over two years.

If your life insurance benefit has been delayed contact an attorney immediately. Often times this delay is used to investigate the claim and fabricate a basis for denial. Missouri law states that, “Failing to acknowledge and act reasonably promptly upon communications with respect to claims arising under insurance policies” and “failing to adopt and implement reasonable standards for the prompt investigation of claims” constitute improper claims practices. Mo. Ann. Stat. § 375.1007(2) and (3) (2006). Don’t let the insurance company string you along while they build their case for denial.
