Insurable Interests in Life Insurance Cases

What is an Insurable Interest?
To establish an insurable interest under Missouri Law, a party is required to show a benefit or advantage from the continuance of the life of the insured. Country Life Ins. Co. v. Marks, 592 F.3d 896 (8th Cir. 2010). In Missouri, an insurable interest in the life of an insured can be based upon three different types of relationships:
- A Pecuniary Relationship
- A Blood Relationship
- A Relationship Based Upon Affinity
We see the most issues arise from the determination of whether there is a pecuniary relationship. While the law in Missouri is constantly evolving, generally speaking a pecuniary relationship can be found in the following circumstances:
- A business association for the benefit to the insured and the beneficiary.
- One partner in the life of another partner.
- The owner of a business in the life of a customer.
- A business enterprise in the life of its’ manager.
- A creditor in the life of his debtor.
- A close friendly relationship.
